House Enrolled Act 1459: Asset Management Planning for Water & Wastewater Utilities - Please comment by September 4th

The Indiana General Assembly passed House Enrolled Act 1459 last session, which was signed into law effective July 1, 2025. As part of the new Ind. Code § 8-1-2-128, water utilities and wastewater utilities not under the Indiana Utility Regulatory Commission’s (Commission’s) jurisdiction for approval of rates and charges to submit a report on the status of the utility’s asset management program to the Commission on a quadrennial basis.

To help outline this process and provide clarity and guidance on the overall program expectations, the Commission has drafted a strawman General Administrative Order (GAO). In the draft, the GAO includes the purpose and general process for this reporting timeline, information to be included in the report, procedures for submitting a report, and criteria to be used by Commission staff.

The Commission is required to issue the GAO outlining the general process prior to October 1, 2025. In the strawman draft GAO, the Commission is not anticipating requiring submission of reports from water and wastewater utilities until July 2026.
